Construction Litigation

Residential and commercial construction is a heavily regulated industry. There are many laws and regulations that dictate how building contractors or developers or homeowners enforce their rights. When a construction project goes bad, when a subcontractor performs substandard work, when a homeowner fails to pay, you need an experienced construction attorney on your side.

Experience Highlights

Our attorneys bring decades of experience representing builders and contractors and homeowners on a broad spectrum of matters relating to construction litigation, including breach of contract, construction defects, construction liens, breach of warranty, construction delay, and contract review and analysis.

  • Mechanics Liens
  • Debtor/creditor Litigation
  • Extra Work Claims
  • Construction Claims
  • Insurance coverage.
  • Permitting and regulatory allowances.
  • Public bidding.
  • Adjoining landowner disputes.
  • Design changes, deficiencies and defects.
  • Defective workmanship claims.

Mechanics Liens

mechanic’s lien is a constitutional remedy that allows prime contractors, subcontractors and material suppliers to foreclose on property when they have not been paid for their work. In order to be able to file a mechanic’s lien, and if you are either a subcontractor or a material supplier, you need to file a preliminary notice with the owner at the start of the project to give the owner notice that you are working on the project. Without notice, a mechanic’s lien is virtually impossible to enforce.

Extra Work Claims

The construction law lawyers at Karpeles & Associates handle non-payment matters that arise in both public and private works construction projects. These matters may include an owner failing to pay a prime contractor for work and materials, failing to pay for recognized extra work or work under the contract or non-payment to subcontractors or material suppliers by a prime contractor.

Construction Claims

Often times construction law disputes arise from delay in production or change in scope of work. Such changes typically result in cost increases, some of which can be very significant for the prime contractor, subcontractor, and the owner. Karpeles & Associates has significant experience in the litigation of complex construction claims pertaining to the increased costs associated with the issuance or non-issuance of a contract change order.

Complex Litigation

Karpeles & Associate’s litigation experience is extensive. We represent clients before state and federal trial courts. We also engage in all methods of alternative dispute resolution (ADR), including mediation, arbitration and summary jury trials.

In addition, Karpeles & Associates litigators have successfully handled appeals in all appellate levels of the state and federal court systems. We handle appeals involving not only cases we have tried, but also cases referred to us from other lawyers who seek our specialized experience in the appellate courts.
